Court Stops FCCPC from Enforcing Digital Lending Regulations

A Federal High Court sitting in Lagos has restrained the Federal Competition and Consumer Protection Commission (FCCPC) from enforcing its Digital, Electronic, Online and Non-Traditional Consumer Lending Regulations 2025.

The interim order was granted by Justice A. Lewis-Allagoa following an application filed by the Wireless Application Service Providers Association of Nigeria (WASPAN).

The court directed the FCCPC and its agents to suspend enforcement of the disputed regulations pending the determination of a substantive suit.

WASPAN had challenged the FCCPC’s authority over aspects of digital lending, arguing that the regulations could disrupt telecom-based services such as airtime and data credit systems.

The case stems from FCCPC directives requiring telecom operators to use only approved airtime credit service providers, a move that has already led to the suspension of airtime borrowing services across networks.

The court’s ruling halts further enforcement until the matter is fully heard and decided.
